Case 16-17 A – Appeal of a ruling of the Zoning Enforcement Officer – 34 Shore Acres, Lacy
A Motion was made by N. Hutchinson, seconded by K. Conniff to UPHOLD the ruling of the Zoning Enforcement Officer for 34 Shore Acres. The reason for upholding the decision is that the newly expanded lot would not correspond with the legal description of the “Lot of Record” (per Section 3-111), which in this case is the Lot for which a Deed was recorded in 1925 prior to the effective date of the Old Lyme Zoning Regulations, it would be a newly created lot. And, any new Lot created after July 15, 1990 must comply with Section 8.4 Minimum Area of Buildable Land. As this reasonable and rationale interpretation of the Old Lyme Zoning Regulations aligns with the decision of the ZEO, that the newly created lot is not exempt from the Minimum Area of Buildable Land (MABL) requirement
(Section 8.4) , the decision is upheld. No further discussion and a vote was taken. In favor: J. McQuade, M. Stone, K. Conniff, M. Hartmann, N. Hutchinson Opposed: None Abstaining: None The motion passed unanimously. 5-0-0

A Motion was made by M. Stone, seconded by M. Hartmann to adjourn the October 26, 2016 Special Meeting. No further discussion and a vote was taken. In favor: J. McQuade, M. Stone, K. Conniff, M. Hartmann, N. Hutchinson Opposed: None Abstaining: None The motion passed unanimously. 5-0-0 The meeting adjourned at 2:55 p.m.
